OFFICIAL GIVEAWAY RULES (“Official Rules”)
AUTOMATION ANYWHERE SWAG PACK GIVEAWAY.
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL FEDERAL, STATE, LOCAL, AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
1. ELIGIBILITY
To enter the AUTOMATION ANYWHERE SWAG PACK GIVEAWAY (the “Promotion”) you must be: (1) at least eighteen (18) years old at the time of entry; (2) must not be an Excluded Individual; and (3) you must follow the instructions described in Section 6 (“How To Enter”) below. The Promotion is subject to federal, state, and local laws and regulations.
2. EXCLUDED INDIVIDUALS
The following individuals are excluded from participating in the Promotion (“Excluded Individuals”)
- Individuals who are residents of a country, state, province or territory where the laws of the United States or local law prohibits participating in the Promotion (including, but not limited to, Brazil, Quebec, as well as Cuba, Iran, North Korea, Syria or any other country designated by the United States Treasury’s Office of Foreign Assets Control); and
- Employees of Automation Anywhere and other companies associated with the Promotion, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and any other household members of each such employee.
3. AAI
The Promotion is sponsored by Automation Anywhere, Inc. (“AAI”), located at 633 River Oaks Parkway, San Jose, CA 95134 (“AAI”).
4. AGREEMENT TO OFFICIAL RULES
Participation in the Promotion constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of AAI, which are final and binding. Winning a Prize (defined below in Section is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein. All government-imposed taxes are the sole responsibility of the winner. By entering the Promotion, you are giving AAI permission to add you to its marketing communications list.
5. PROMOTION PERIOD
The Promotion begins on at the start of each Automation Anywhere Pathfinder Community event and ends at the conclusion of the event. Entries that are submitted before or after the Promotion Period will be disqualified.
6. HOW TO ENTER
To be entered to win a swag pack, you must register and attend a Pathfinder Community Event (“Event”), including but not limited to: User Groups, Product Club Meetings, Developer Meetups, and Bot Camp sessions. You can register for upcoming events at https://community.automationanywhere.com/events.
7. WINNER NOTIFICATION
Names will be entered into the drawing for one (1) of three (3) AAI Swag Packs available for each Event. If your name is selected, we will notify you via email and arrange the prize to be fulfilled within 3-4 weeks via ground shipping. Should the shipment take longer than this anticipated timeline, Automation Anywhere will notify the winner.
8. PRIZES
Automation Anywhere Swag Pack. Each Swag Pack contains one (1) t-shirt, one (1) pen, and two (2) stickers. Approximate Retail Value: $20 USD (“Prize”). Prize is non-transferable and no substitution will be made except as provided herein at AAI's sole discretion. AAI reserves the right to substitute a Prize for one of equal or greater value if the designated prize should become unavailable for any reason. Prizes will be given to three (3) randomly selected individuals who successfully complete the instructions in Section 5 and submit their name into the drawing to win one (1) of the three (3) prizes (“How To Enter”).
If required by the IRS, AAI will issue a Form 1099-MISC to the winner reporting the fair market value of the Prize for the 2024 calendar year. This information will also be submitted to the IRS. Winner is encouraged to consult with his/her tax advisor before accepting the Prize.
9. GENERAL CONDITIONS
In the event that the operation, security, or administration of the Promotion is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Promotion is unable to run as planned for any other reason, as determined by AAI in its sole discretion, AAI may, in its sole discretion, either (a) suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Promotion and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. AAI reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the collection portal or undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, AAI reserves the right to seek damages (including attorneys fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by AAI to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
10. RELEASE AND LIMITATIONS OF LIABILITY
By participating in the Promotion, entrants agree to release and hold harmless AAI, and each of their respective parents, subsidiaries, affiliates, advertising and promotion agencies, other companies associated with the Promotion, and each of their respective officers, directors, employees, shareholders, representatives, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Promotion or receipt or use of the prize (including any travel or activity related thereto), including, but not limited to: (a) any technical errors associated with the Promotion, including lost, interrupted or unavailable Internet Service Provider (ISP), network, server, wireless service provider, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone, cellular tower or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties; (b) unauthorized human intervention in the Promotion; (c) mechanical, network, electronic, computer, human, printing or typographical errors; (d) any other errors or problems in connection with the Promotion, including, without limitation, errors that may occur in the administration of the Promotion, the announcement of the winner, or in any Promotion-related materials; or (e) injury, death, losses or damages of any kind, to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Promotion or acceptance, receipt or misuse of the Prize (including any travel or activity related thereto). Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the Promotion, and in no event shall the entrant be entitled to receive attorney fees. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Promotion. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
11. DISPUTES
Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Santa Clara County, California. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants’ rights and obligations, or the rights and obligations of AAI in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of California, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than California.
